Polychlorinated Biphenyls

Polychlorinated biphenyls (PCBs), are regulated under the Toxic Substances Control Act (TSCA). In North Dakota, PCBs are not considered to be a hazardous waste.

Regulations concerning PCBs may be found in Title 40 Code of Federal Regulations (CFR), Chapter I, Subchapter R, Part 761. North Dakota is not authorized to implement these regulations, but has entered into a cooperative agreement with the Environmental Protection Agency (EPA) to conduct inspections of facilities for proper disposal of PCB wastes. A representative of the Hazardous Waste Program conducts the inspection and prepares an inspection report which is sent to EPA Region VIII for compliance evaluation and enforcement actions.
